General Terms And Conditions

Kindly read these general terms and policies of the service agreement carefully, as it holds important information regarding your legal rights and remedies.

Overview

Changes to services, prices, fees and these Terms are subject to the notice requirements and protections described in these Terms and applicable law.

These Terms and Conditions form a binding agreement between you and Hostonce LLC, a limited liability company organized under the laws of Wyoming, United States ("Hostonce," "we," "us," or "our"). Our company mailing address is 30 N Gould St Ste R, Sheridan, WY 82801, United States. These Terms apply when you visit the Hostonce website, create an account, place an order, or access or use any Hostonce product or service.

By accepting these Terms, you agree to them on your own behalf or on behalf of the company you are authorized to represent. Service-specific agreements and additional policies also apply where relevant to the services you purchase or use.

Hostonce LLC may improve, replace, limit, or discontinue a feature and may revise prices or fees. Where a change materially affects an active paid Service, it will normally apply from the next renewal or after any notice required by law. Hostonce may update these Terms as described under Amendments and Revisions.

Hostonce provides Shared Web Hosting, WordPress Hosting, VPS Hosting, VDS Hosting, Windows Hosting and Dedicated Servers, together with domain registration and transfer, SSL certificates, website migration assistance, HovexBuilder, Stackbase and HovaAI. Only the services, features and resources included in your accepted order are supplied.

Eligibility: Authority

This Site and the Services are available only to Users who can form legally binding contracts under applicable law. By using this Site or the Services, you represent and warrant that you are:

  • You are at least 18 years old or have reached the legal age of majority where you live.
  • You are not prohibited by law, sanctions, court order, or another binding restriction from receiving the Services.
  • If you order for a company or another person, you have the authority to bind that customer and provide accurate billing and account information.

You must be at least 18 years old and legally capable of entering a binding agreement. Hostonce may request identity, business, address or payment verification before or after activating a Service. Hostonce may refuse an order where it reasonably suspects fraud, unlawful use, sanctions risk, inaccurate information, an obvious pricing error or a technical inability to supply the requested Service.

Accounts; Transfer of Data Abroad:

You must provide accurate account information and keep it current. You are responsible for all activity carried out through your account, including activity by employees, contractors and other authorized users. You must protect your passwords, authentication methods and recovery details. Notify Hostonce promptly if you suspect unauthorized access. Hostonce may temporarily restrict an account while verifying ownership or investigating a security risk.

You are responsible for protecting account credentials, recovery details, access tokens, and payment information. Use strong passwords, enable available security controls, limit administrator access, and notify Hostonce promptly if you suspect unauthorised access. Until Hostonce receives that notice, you are responsible for activity performed through the account except to the extent the activity was caused solely by Hostonce. To operate a global service, Hostonce and its service providers may process or store account and service data in countries other than your own. Any such transfer will be handled in accordance with the Privacy Policy and applicable data-protection law. You remain responsible for ensuring that data you upload may lawfully be processed in the locations used for your Services.

Financial Arrangements:

  • The customer agrees to a thirty (30) day contract minimum beginning upon commencement of service. The exact contract duration is decided upon at signup.
  • You are responsible for all charges, applicable taxes, usage fees, add-ons, and third-party costs associated with your account.
  • Third-party products and partner services are refundable only where the Cancellation and Refund Policy, the supplier's rules, or applicable law provides a refund.

Automatic Renewal:

Unless you turn off automatic renewal, an eligible Service will renew at the end of its current term for the same period or the closest available renewal period. Renewal is charged at the applicable renewal rate using the primary payment method or an authorised backup method on the account.

You must disable automatic renewal or submit a cancellation request before the renewal date shown in your account. A cancellation made after a renewal charge is handled under the Cancellation and Refund Policy. If payment fails, Hostonce may retry the charge, request another payment method, shorten the renewal period where permitted, or suspend the affected Service until the balance is paid.

Hostonce may use card-account updating services supplied by payment networks where available. You remain responsible for keeping payment details valid and reviewing renewal settings. Failure to renew may result in suspension, data loss, domain expiry, or loss of access, and Hostonce is not responsible where this results from your cancellation, disabled renewal, or failed payment.

  • Refund eligibility and exclusions are explained in the Refund Policy.
  • A material breach may result in suspension or termination under these Terms. Refund eligibility remains subject to the Cancellation & Refunds Policy and any rights that cannot be excluded by law.
  • Hostonce may restrict an affected service when reasonably necessary to investigate a suspected breach, protect security or comply with law. Where circumstances permit, we will provide notice and an opportunity to address the issue.
  • Billing disputes, any related account restrictions, and recovery of actual payment-provider fees are handled under the Billing Disputes and Chargebacks section of the Refund Policy, subject to applicable law and payment-provider rules. This does not restrict a customer's right to raise a legitimate payment dispute.
  • Changes to plans, prices or maintenance fees follow the notice requirements in these Terms and normally apply from the next renewal. Customers may cancel before the change takes effect. Cancellation does not remove accrued refund rights or remedies required by law; eligibility otherwise follows the Refund Policy.

You agree to pay all fees and charges associated with your use of Hostonce services, including subscription fees, transaction fees, and other applicable charges. Payment must be made in advance unless otherwise agreed in writing. If payment is overdue, we may suspend or terminate access to the affected services. Refund eligibility is governed by the Refund Policy, applicable service-specific terms and any rights required by law. Changes to fees are subject to the notice requirements described in these Terms.

A serious or repeated breach of these Terms may result in suspension or termination without refund, subject to applicable law. Improper chargebacks may also lead to account restrictions and recovery of reasonable costs charged to Hostonce by the payment provider.

General Rule of Conduct:

You agree to the following rules when using Hostonce's website and services:

  • Use the Site, Services and any content you submit in accordance with these Terms, the applicable service policies and all applicable laws.
  • Do not collect, store or disclose another person's non-public or personal information without a lawful basis and any required permission.
  • Do not use the Site or Services to:
    • Engage in unlawful activity or support criminal conduct.
    • Promote or engage in child exploitation or the creation, possession or distribution of child sexual abuse material.
    • Promote terrorism or violence against people, animals or property.
    • Promote or distribute pornographic content or nude imagery, or solicit sexual services.
    • Encourage or facilitate the violent activities prohibited above, including through fundraising or recruitment.
    • Send spam, distribute unsolicited bulk messages, or gain unauthorized access to computers or networks.
    • Promote or engage in sales of marijuana, CBD or products containing THC.
    • Sell or distribute prescription medicines unlawfully, including without a valid prescription where one is required.
    • Promote or facilitate sex trafficking or unlawful prostitution.
    • Infringe another person's intellectual property rights.
    • Promote gambling, casinos, gaming, sports betting, daily fantasy sports, lottery or chain letters regardless of content or origin and regardless of your citizenship or the legality of such activities within your country or jurisdiction.
    • Violate privacy, publicity or confidentiality rights.
    • Interfere with the operation or security of the Site or Services.
    • Introduce malware or other code designed to damage, disrupt or gain unauthorized access to software, hardware or data.
    • Make knowingly false or misleading factual statements about Hostonce or its services. This does not restrict honest reviews, opinions or lawful complaints.
    • Host, distribute, or otherwise make available any material that promotes or supports any illegal or banned organization, including but not limited to terrorist organizations or hate groups. This includes, but is not limited to, propaganda, literature, or other materials that express support for such organizations or promote their activities. Any violation of this clause may result in immediate termination of the customer's account, and Hostonce reserves the right to take legal action as necessary. The company will fully cooperate with law enforcement agencies in investigating any illegal activity related to its services.
    • Hosting, distribution, possession, or access of any form of pornography, including child pornography, through its services. Customers who violate this policy will have their accounts terminated immediately, and Hostonce reserves the right to take legal action as necessary. Customers who become aware of any illegal activity involving the company's services, including child pornography, must report it to the company immediately.
    • Hostonce prohibits pornography and applies a zero-tolerance policy to child sexual abuse material. Report suspected illegal content through the abuse-reporting channel. Violations may result in termination and referral to the appropriate authorities.
    • Do not engage in unlawful defamation, impersonation or harassment. Honest customer reviews, good-faith complaints, lawful dispute claims and communications with regulators are not prohibited and will not themselves result in a penalty or termination.
    • Use Shared, VPS, or VDS Services for cryptocurrency mining, automated game bots, intrusive security activity, or workloads prohibited by the applicable plan or resource policy.
  • Do not copy or distribute Hostonce-owned content without permission, except where applicable law permits it. You retain ownership of your own content.
  • Do not modify Hostonce-owned software or website content without permission, except as permitted by its license or applicable law.
  • Access the Services through authorized interfaces and tools. Do not bypass access controls.
  • Do not resell Hostonce services or technologies without prior written authorization.
  • Do not disable, bypass or interfere with security features, usage limits or measures that protect Hostonce or customer content.
  • Provide reasonable identity or business verification when requested through Hostonce's authorized verification process.
  • Hostonce may contact you about your account or services using your contact details. Where calls are recorded, any required notice or consent will be provided or obtained. Recordings and contact information are handled as described in the Privacy Policy.
  • Providing a telephone number does not by itself authorize marketing calls or text messages. If such communications are offered, Hostonce will obtain any consent required by law and provide a way to withdraw it. Marketing consent is not a condition of purchase.
  • Hostonce may restrict access where reasonably necessary to address a material breach, illegal activity, security risk or an attempt to evade a prior lawful suspension. Applicable notice requirements and mandatory customer rights continue to apply.
  • These rules of conduct apply to Hostonce services and are subject to applicable laws and regulations.

Availability of Service:

Hostonce uses commercially reasonable measures to keep the Site and Services available. Temporary interruption may occur because of maintenance, upgrades, security events, equipment failure, network congestion, supplier outages, attacks, emergencies, legal requirements, or events beyond reasonable control.

No Service is guaranteed to be continuous or error-free unless a written service-level agreement expressly says otherwise. Scheduled maintenance, customer-caused issues, third-party failures, and force-majeure events may be excluded from an uptime commitment. Your remedies for a qualifying outage are limited to those stated in the applicable service-level agreement and any rights that cannot legally be excluded.

Credited Product:

A promotional credit, free product, or discounted add-on is governed by the offer shown when it is issued. Unless the offer states a different period, an unused credit expires 12 months after issue. Credits are personal to the account, have no cash value, and may require an active qualifying purchase. If the qualifying Service is cancelled, transferred, deleted, charged back, or not renewed, the related credit or free product may end. Where a refundable package included a free domain or another non-refundable item, its standard price may be deducted from the refund as stated in the Cancellation and Refund Policy. After a free or discounted term, a Service may renew at the current standard price if automatic renewal remains enabled. If a promotional item is unavailable or no longer supported, Hostonce may replace it with a reasonably comparable item or account credit. Fraud, duplicate claims, or misuse of a promotion may result in withdrawal of the benefit.

Beta Services:

Hostonce may offer previews, trials, experimental functions, or pre-release products identified as Beta Services. Participation is optional. Beta Services may be incomplete, unstable, changed without notice, or discontinued at any time.

  • Do not rely on a Beta Service for production, safety-critical, regulated, or business-critical workloads unless Hostonce agrees otherwise in writing.
  • Support, compatibility, availability, backups, and service-level commitments may be limited or unavailable.
  • Beta features may collect diagnostic and usage information as explained in the Privacy Policy
  • You grant Hostonce a perpetual, worldwide, royalty-free right to use feedback you voluntarily provide to improve, test, and market its products. You retain ownership of your pre-existing materials.
  • A production release may differ from a beta version, and beta data, integrations or configurations may not carry over.
  • Support availability and response times for beta features may be limited, as described for the beta.
  • If you provide feedback, include enough information to help reproduce the issue, without submitting secrets or unnecessary personal data.
  • Diagnostic and usage data collected through beta features is handled under the Privacy Policy and any applicable consent requirements.
  • Any separate confidentiality conditions for a beta must be disclosed before participation. These Terms do not restrict honest reviews or lawful disclosures to regulators.
  • Beta Services are provided as available, subject to applicable law and any express commitments in the beta offer.

Feedback may be used under the license described in the Beta Services section. You retain ownership of your content and pre-existing intellectual property; using a beta does not transfer that ownership to Hostonce. Any warranty exclusions are subject to the protections stated in these Terms and applicable law.

Fees and Payments:

Hostonce or an authorised payment processor will charge the payment method selected at checkout. The name appearing on your statement may be Hostonce, the contracting entity identified on the invoice, or the relevant payment provider. Payment data is handled under the Privacy Policy and the processor's terms.

The checkout total is the amount submitted for payment. Your bank, card issuer, wallet provider, or payment platform may add conversion, international, or processing charges that Hostonce does not control. Taxes may be added based on your billing information, service location, or applicable law. You must provide valid tax information if claiming an exemption.

An order is not accepted until payment is authorised and Hostonce confirms activation. Hostonce may correct an obvious pricing or configuration error before activation or, if already activated, offer the correct terms or cancel and refund the affected order where appropriate.

General Terms, Including Automatic Renewal Terms:

General Terms are as follows:

  • Amounts are due when ordered and are non-refundable except as stated in the Cancellation and Refund Policy or required by law.
  • Price changes for a prepaid Service normally take effect at its next renewal. Usage-based or third-party charges may change when the underlying usage or supplier price changes.
  • Payment methods and currency:
    • Use a payment method displayed at checkout for your order. Availability may depend on the service, currency, location and payment provider.
    • The order summary identifies the purchase currency, billing period, total amount and any applicable taxes or fees. A displayed monthly equivalent is not a monthly charge when the order requires prepayment for a longer term.
    • You must be authorized to use the selected payment method. A failed or unauthorized payment may delay activation or lead to restriction of the affected service.
  • Order and billing notices are sent to the contact details on your account. Keep those details and your payment method current. Payment processing may involve service providers in other countries, as described in the Privacy Policy.
  • For refund-related issues, check our Refund Policy.
  • A monthly billing date normally follows the activation date. If that date does not exist in a later month, billing may occur on the final day of that month.
  • You can review your subscriptions and renewal settings in the Hostonce Client Area. Contact Billing if you need help identifying an order or recurring charge.
    • Eligible subscriptions renew according to the Automatic Renewal section above and the settings shown for the purchased service. Domain names may have different expiry, renewal and recovery deadlines under registrar or registry rules.
    • Automatic renewal follows the Automatic Renewal section above. You can review or change renewal settings in your Hostonce account. If automatic renewal is disabled, the service will expire at the end of its paid term unless you renew it manually before expiry. Expiry may result in interruption of service or loss of access and data.
  • Payment-network account-updater services may update an authorized card's details where supported. This does not remove your responsibility for:
    • Canceling unwanted subscriptions or disabling their renewal before the applicable deadline.
    • Keeping authorized payment methods and billing details current.
  • A failed renewal payment can interrupt service or lead to expiry. The Automatic Renewal section explains the applicable process, subject to mandatory legal protections.
  • Additional charges may apply only where disclosed in the order or these policies and permitted by applicable law. Examples include:
    • Separately agreed work outside the support or management scope of the purchased plan.
    • Additional technical work requested by the customer and quoted before it is performed.
    • Reasonable, disclosed costs arising from a substantiated breach, where recoverable under the agreement and law.
    • Domain-dispute costs or actual payment-provider dispute fees where permitted and described in the applicable policy. Billing disputes and chargebacks follow the Cancellation & Refunds Policy; this clause does not create a separate automatic dispute penalty.
  • Any additional charge must identify its basis and amount. Payment collection must use an authorized method and comply with applicable law and payment-provider rules.
  • The purchase currency and total are shown at checkout. Your bank or payment provider may charge conversion or international transaction fees outside Hostonce's control. Applicable taxes are calculated from the order and billing information.

Additional Reservation of Rights:

Hostonce may reject an order or restrict, suspend, lock, cancel, transfer, or modify an Account or Service when reasonably necessary to:

  • Correct an obvious service, billing, provisioning, domain-registry, or configuration error.
  • Prevent or investigate fraud, abuse, security incidents, sanctions violations, or harm to Hostonce, its customers, or another network.
  • Comply with law, a valid court order, a regulatory request, a registry or registrar requirement, or an applicable dispute-resolution decision.
  • Protect legal rights, preserve evidence, respond to a credible claim, or avoid material civil or criminal exposure.
  • Address non-payment, resource overuse, service degradation, or repeated complaints supported by reasonable evidence.
  • Participate in an applicable domain-dispute or other binding dispute-resolution procedure.
  • Preserve relevant records for a valid legal proceeding, subject to privacy law.
  • Address a substantiated legal or security risk. Filing a lawful claim or complaint against Hostonce is not itself grounds to suspend a service.
  • Respond to valid legal process under the Court Order & Subpoena Policy and applicable law.
  • To cooperate with law enforcement agencies in investigating any illegal activity related to its services.
  • Investigate substantiated abuse reports concerning an account, domain or hosted content; complaint volume alone does not establish a violation.

Hostonce may review resource use and enforce the limits of the purchased plan. Any additional resource charges must be disclosed under the applicable service terms and law.

Where circumstances permit, Hostonce will give notice and a reasonable opportunity to correct the issue. Immediate action may be taken where delay could cause harm, create legal exposure, threaten infrastructure, or compromise security. Resource use is also subject to the plan limits and the Unlimited Bandwidth or Fair Use policy.

Except for content you own or lawfully license, all software, designs, text, graphics, interfaces, code, trademarks, and other material supplied by Hostonce remain owned by Hostonce or its licensors. Hostonce grants you a limited, revocable, non-transferable right to use that material only as needed to receive the Services. You grant Hostonce the limited rights needed to host, transmit, back up, and otherwise process your content to provide and protect the Services.

Trademark/Copyright Claims:

Hostonce respects intellectual-property rights and expects customers to do the same. A rights holder may report allegedly infringing material through the Hostonce abuse-reporting channel. A notice should identify the protected work or mark, identify the disputed material and its location, provide reliable contact details, explain the basis of the claim, and include any statements or signature required by applicable law.

Hostonce may forward the complaint to the affected customer, request additional evidence, restrict access to the material, preserve records, or take other action required by law. Where United States law applies, Hostonce will process valid copyright notices and counter-notices under the Digital Millennium Copyright Act. Domain-name trademark disputes may be referred to the applicable UDRP, URS, registry, or court procedure

A customer receiving a complaint must respond promptly and must not restore disabled material without permission. Repeat or serious infringement may result in termination. A person who knowingly submits a false or misleading claim may be responsible for resulting loss or liability.

Customers who believe another Hostonce user has infringed their intellectual property rights may submit a formal content-removal request under applicable intellectual property law. Include a description of the allegedly infringing material and the basis for the claim, together with the information required by the applicable legal procedure.

Upon receipt of these requests, Hostonce is committed to conducting an investigation that respects the local legal frameworks. The process focuses on fostering mediation and seeking amicable resolution, while ensuring adherence to the laws and regulations of each particular jurisdiction. This approach emphasizes a balanced handling of intellectual property rights concerns, blending legal compliance with a dedication to constructive dialogue and resolution in matters of intellectual property rights.

Hostonce takes the issue of intellectual property rights very seriously and encourages its customers to use the services responsibly and in compliance with all applicable laws and regulations.

Linking to Third-party Websites:

The Site or Services may link to websites, applications, payment providers, registries, marketplaces, or tools operated by others. A link does not mean Hostonce controls or endorses the third party. Hostonce is not responsible for third-party content, availability, security, products, privacy practices, or terms. When you leave the Hostonce Site or enable an external integration, review the third party's terms and privacy information. Your dealings with that party are between you and the third party unless Hostonce expressly agrees otherwise in writing.

Disclaimer of Representations and Warranties:

Except for an express written warranty or service-level commitment, and to the maximum extent permitted by law, the Site and Services are provided as available and with their existing faults. Hostonce does not promise that every Service will be uninterrupted, error-free, completely secure, compatible with every system, or suitable for a particular purpose.

  • The completeness or accuracy of general website information, except for express service descriptions or commitments.
  • Third-party websites and content linked from the Site.
  • Compatibility with every possible customer configuration, except where expressly promised for the purchased service.

Hostonce and its suppliers disclaim implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement to the extent those warranties may lawfully be excluded. Information provided by support, documentation, automated tools, or artificial-intelligence features is general assistance and does not create a warranty or constitute legal, financial, tax, or professional advice.

Nothing in this section limits an express guarantee in your order, the Cancellation and Refund Policy, a written service-level agreement, or any consumer right that applicable law does not allow Hostonce to exclude.

Indemnification:

To the extent permitted by law, you will defend, indemnify, and hold harmless Hostonce, its affiliates, officers, employees, agents, and suppliers from third-party claims, losses, liabilities, penalties, and reasonable legal costs arising from:

  • Any injury to person or property caused by any products sold or otherwise distributed in connection with Hostonce 's Server;
  • Any material supplied by Customer infringing or allegedly infringing on the proprietary rights of a third party;
  • Copyright infringement;
  • Any defective product that the Customer sold on Hostonce's servers.
  • Your unlawful or unauthorized use of the Site or Services.
  • Your material breach of these Terms or an incorporated service agreement.
  • Your infringement of a third party's rights. Indemnification applies only to the extent permitted by law and does not require you to cover loss caused by Hostonce's own unlawful conduct.

Limitation of Liability

To the maximum extent permitted by law, Hostonce and its affiliates, officers, employees, agents, and suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profit, revenue, business, goodwill, anticipated savings, data, or opportunity, arising from the Site or Services even if the possibility of that loss was disclosed.

  • Errors or omissions in general website information, subject to express commitments and mandatory rights.
  • Third-party websites or content linked from the Site.
  • Third-party services that are not supplied by Hostonce under the accepted order.
  • Property loss connected with use of the Services, only to the extent liability may lawfully be limited.
  • Conduct of independent third parties outside Hostonce's reasonable control.
  • Unauthorized access to systems or data, subject to Hostonce's applicable contractual and legal security obligations.
  • Service interruption, subject to an applicable service-level agreement and mandatory rights.
  • Malware or other harmful code affecting the Services, subject to applicable contractual and legal obligations.
  • Unlawful or harmful customer content, to the extent liability may lawfully be excluded.
  • Losses arising from use of the Site or Services, subject to the liability limits and exceptions stated in this section.
  • Service availability and warranty commitments are those expressly stated in the order, service description, applicable service-level agreement and these Terms. Nothing here removes a right that cannot legally be excluded.
  • Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, or any other liability that applicable law does not permit to be excluded or limited.
  • The aggregate liability cap is stated immediately below. It is subject to the non-excludable liabilities and mandatory consumer rights identified in these Terms.
  • Disclosures of customer data must comply with applicable law and the Privacy Policy. This section does not excuse an unlawful disclosure or remove a remedy that cannot legally be excluded.

This exclusion includes loss arising from downtime, transmission failure, deletion or corruption of files, malware, unauthorised access, third-party conduct, external links, customer content, registry action, or the inability to use a Service. You are responsible for maintaining independent backups unless your order expressly includes a managed-backup obligation.

Hostonce's total aggregate liability for all claims connected with a Service will not exceed the amount you paid to Hostonce for the affected Service during the six months immediately before the event giving rise to the claim. If you paid nothing for the affected Service, Hostonce's liability is limited to USD 100 or the minimum amount required by law, whichever is greater.

Prohibited Content and Activities:

Without limiting the General Rule of Conduct, the following content and activities are prohibited on Hostonce systems:

  • Illegal content or activity, including child sexual abuse material, trafficking, unlawful weapons or controlled substances, fraud, or material that unlawfully supports a banned organisation.
  • Copyrighted, trademarked, confidential, or personal material used without the rights or permission required by law.
  • Hacking tools or instructions intended for unauthorised access, credential theft, exploitation, malware delivery, botnets, scanning, spoofing, or evasion of security controls.
  • Denial-of-service attacks, deliberately harmful configurations, traffic amplification, or activity that interrupts Hostonce or any outside service.
  • Spam infrastructure, open relays, purchased mailing lists without valid consent, bulk messaging tools used for unsolicited communication, or sites promoted through spam.
  • Phishing, impersonation, deceptive collection of credentials, personal-information harvesting, scams, or forged email and network headers.

You are responsible for the legality, integrity, licensing, and security of content stored or transmitted through your account. Hostonce may investigate reports, preserve relevant records, restrict content, suspend a Service, or refer suspected crime to the appropriate authority. Hostonce's right to take action does not make it the publisher or guarantor of customer content.

No Spam; Liquidated Damages:

Because the harm and investigation cost caused by large-scale spam may be difficult to calculate, you agree that, where permitted by law, Hostonce may claim liquidated damages of USD 1.00 for each prohibited message sent from, through, or in connection with your account. This amount is intended as a reasonable estimate rather than a penalty and does not prevent Hostonce from seeking a different remedy where law requires or allows it.

Hostonce does not permit unsolicited commercial email, unsolicited bulk email, unsolicited messages, open relays, list harvesting, or the use of third-party services to send spam on a customer's behalf. Marketing messages must have a lawful basis, accurate sender information, a working opt-out method, and evidence of valid consent where consent is required.

Hostonce may investigate suspected spam, rate-limit or block traffic, suspend the affected website, domain, server, or mailbox, and require a written remediation plan or a reasonable reactivation fee before restoring service. Suspected spam may be reported through https://hostonce.com/report-abuse.

If we determine the account, products, or services in question are being used in association with spam, we may re-direct, suspend, or cancel any account, web site hosting, domain registration, email boxes, or other applicable products or services. In such event, at our election, we may require you to respond by email to us stating that you will cease to send spam and/or have spam sent on your behalf and to require a non-refundable reactivation fee to be paid before the site, email boxes, and/or services are reactivated.

Report suspected spam to [email protected] or through the Report Abuse page. Include the relevant message headers and details needed to investigate, but do not send passwords or unrelated personal information.

Sanctioned Countries:

The customer agrees to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations ("EAR") maintained by the U.S. Department of Commerce, trade and economic sanctions maintained by the Treasury Department's Office of Foreign Assets Control, and the International Traffic in Arms Regulations ("ITAR") maintained by the Department of State. Specifically, Customer covenants that it shall not, directly or indirectly, sell, export, re-export, transfer, divert, or otherwise dispose of any products, software, or technology (including products derived from or based on such technology) received from Hostonce under this Agreement to any destination, entity, or person prohibited by the laws or regulations of the United States, without obtaining prior authorization from the competent government authorities as required by those laws and regulations. Customer agrees to indemnify, to the fullest extent permitted by law, Hostonce from and against any fines or penalties that may arise as a result of Customer's breach of this provision. This export control clause shall survive termination or cancellation of this Agreement.

Compliance with Local Law:

The availability of a Site feature does not mean that the feature or the way you intend to use it is lawful in every country. You are responsible for laws that apply to your location, customers, content, industry, data, and use of the Services, including licensing, consumer, privacy, export, tax, and communications requirements. Hostonce may restrict a product, feature, payment method, or location where necessary for compliance or risk management. Information supplied by Hostonce about legal or regulatory topics is general information only and is not legal advice.

Unclaimed Property

An unused credit, refund, or other account balance may become subject to the unclaimed-property law applicable to the Hostonce LLC contracting entity or the customer's last known address. After the legally required dormancy period and notice, Hostonce may remit the balance to the appropriate government authority. Once a balance has been remitted, any claim must normally be made to that authority. Hostonce may deduct an administrative charge only where the applicable law and the relevant service terms permit it. You are responsible for keeping your postal and email addresses current so that required notices can reach you.

Entirety

These Terms, your order, the service description, any written service-level agreement, and the policies incorporated by reference make up the entire agreement concerning the Services and replace earlier discussions, statements, or understandings about the same subject. If documents conflict, the order of priority is: a separately signed agreement, the order confirmation, a service-specific agreement or service-level agreement, these Terms, and then the incorporated policies, unless a document expressly states another order. The Privacy Policy governs the handling of personal information. A sales statement changes this Agreement only if an authorised Hostonce representative confirms it in writing.

Governing Law

The governing law and dispute forum below identify Hostonce LLC's Wyoming jurisdiction. Mandatory consumer protections and applicable domain rules remain in effect.

  • This Agreement is governed by the laws of the State of Wyoming, United States, without applying conflict-of-law rules that would select another law.
  • If you are a consumer, this choice does not remove mandatory protections that apply in your country of residence.
  • Domain registrations also remain subject to the rules of the relevant registry, registrar, ICANN policy where applicable, and any mandatory domain-dispute procedure.
  • A sales statement changes this Agreement only if an authorised Hostonce representative confirms it in writing

Legal proceedings follow the Jurisdiction and Dispute Resolution sections below, subject to any mandatory right to use another court or procedure.

Dispute Resolution

Before starting formal proceedings, the complaining party should send written notice describing the issue, the relevant account or order, the supporting facts, and the requested resolution. The parties will use reasonable efforts to resolve the dispute in good faith for at least 30 days after receipt, unless urgent relief is needed.

A dispute that is not resolved informally will be handled by the courts described under Jurisdiction, unless a separately accepted service agreement or order requires enforceable individual arbitration. Any arbitration must take place on an individual basis where a class-action waiver is lawful, use a neutral decision-maker, and allow remedies available under the governing law.

Nothing prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.

Jurisdiction

The following forum provisions apply subject to mandatory law and any separately accepted, enforceable dispute-resolution agreement:

  • Subject to mandatory consumer law and any valid arbitration agreement, state courts in Wyoming and federal courts having jurisdiction in Wyoming have exclusive jurisdiction over disputes arising from this Agreement.
  • Each party submits to those courts and waives objections based solely on venue or inconvenience.
  • Hostonce may seek urgent protective relief in any court with authority over the relevant person, data, domain, system, or property.
  • Nothing in these Terms prevents a regulator, law-enforcement authority, registry, registrar, or court from exercising powers granted by law.

The default court forum is stated above. A different forum in an order applies only if separately agreed and enforceable under applicable law.

A consumer may retain the right to bring a claim in another court where mandatory law permits it.

Successors and Assigns

This Agreement binds and benefits the parties and their permitted successors and assigns. You may not transfer the Agreement, an account, or a Service without Hostonce's prior written consent, except where a domain-transfer policy or mandatory law permits the transfer. Hostonce may assign this Agreement to an affiliate or as part of a merger, restructuring, financing, or sale of all or part of its business, provided the assignment does not remove any mandatory right. Notice will be given where required by law.

No Third-party Beneficiaries

Except where a provision expressly protects a Hostonce affiliate, officer, employee, agent, licensor, supplier, or payment provider, this Agreement does not give enforcement rights or benefits to anyone who is not a party to it.

Amendments and Revisions

Hostonce may revise these Terms by publishing an updated version on the Site. For a material change affecting an active paid Service, Hostonce will provide any notice required by law and will normally apply the change from the next renewal or from the effective date stated in the notice. Your continued use of the Site or Services after the effective date means you accept the revised Terms. If you do not agree, you must stop using the affected Service and cancel before the change takes effect, subject to any existing payment obligation. A revision will not retroactively remove a right or remedy that had already arisen, except where law requires the change.

Titles and Headings

Titles and headings are included only to make this Agreement easier to read and do not change the meaning of a provision. Words such as "including" mean "including without limitation." The singular includes the plural and vice versa where the context allows. References to a policy mean the current version published on the Hostonce legal page. If a translated version differs from the English version, the English version controls to the extent permitted by law. Electronic acceptance, electronic notices, and electronic records have the same effect as their paper equivalents where applicable law permits.

Severability

If a court or other competent authority finds part of this Agreement unlawful or unenforceable, that part will be limited or revised only as much as necessary to make it enforceable. If it cannot be revised, it will be removed, and the remaining provisions will continue in effect.

A delay or failure to enforce a right is not a waiver of that right. A waiver is effective only if made in writing by an authorised representative and applies only to the specific situation identified. Provisions that by their nature should continue after expiry or termination, including payment, intellectual property, indemnification, liability limits, disputes, and governing law, will survive.

Service Scope and Digital Delivery

Hostonce supplies digital services rather than physical goods. Access is provided electronically through the Client Area, a product dashboard or service credentials. An order may require successful payment, account verification and technical provisioning before it becomes available. Domain transfers and certificate issuance also depend on third-party validation or registry processes.

Provisioning time depends on the service and any verification or configuration required. Contact Support through the Client Area for the status of an order or before ordering if a particular delivery date is essential. If we cannot supply an accepted order as agreed, we will contact you about available alternatives or cancellation and any applicable refund. Mandatory rights relating to non-delivery remain unaffected.

  • WordPress Hosting: Hosting plans for WordPress websites.
  • VPS Hosting: Virtual private servers with the resources specified in the selected plan.
  • VDS Hosting: Virtual dedicated server plans for projects requiring dedicated resource allocations.
  • Windows Hosting: Windows-based server hosting; the plan and order specify the operating system, access and licensing.
  • Dedicated Servers: Dedicated server hardware with the configuration specified in the order.
  • Domain Registration: Domain registration through registrar partners, subject to availability and registry rules.
  • Domain Transfer: Transfers of eligible domain names, subject to registrar and registry requirements.
  • SSL Certificates: Certificates for supported domains, subject to the relevant validation requirements.
  • Website Migration: Website migration assistance within the agreed scope and compatibility requirements.
  • HovexBuilder: AI-assisted website creation and publishing tools.
  • Stackbase: Tools for deploying and managing applications on supported infrastructure.
  • HovaAI: AI-assisted hosting guidance and management features, including HovaAI Advisor.

CPU, memory, storage, bandwidth, locations, operating systems, licenses, management, backups, mailboxes and support scope depend on the selected plan and accepted order. A feature described for one service is not automatically included in another. Mailboxes included with a hosting plan, where specified, are not a separate standalone email-hosting product.

Framework and application pages describe uses of an underlying hosting service; they do not create a separate product or override that service's resource, billing or refund rules. Third-party software may require separate licenses or terms. Customers remain responsible for their applications, content, access permissions and independent backups except where a purchased management service expressly covers a task.

AI-Assisted Tools

HovexBuilder, Stackbase and HovaAI provide the capabilities described for the selected product and plan. Access to one tool does not automatically include a paid subscription to another. Usage limits, supported integrations and any separately charged infrastructure or licenses depend on the accepted order.

AI-generated answers, code and configurations may be incomplete or incorrect. Review output before publishing it or applying changes, keep appropriate backups and do not submit credentials or sensitive information unless necessary through an authorized secure feature. You are responsible for having the rights to content you supply and for checking generated content before use. Personal information is handled under the Privacy Policy.

Refund eligibility for an underlying hosting plan follows its service-specific rules in the Cancellation & Refunds Policy. A separately purchased tool or add-on follows the terms disclosed for that purchase and applicable law. If refund eligibility is unclear, ask Billing before placing the order; this section does not create a blanket non-refundable rule.

Cancellation and Contact

To stop renewal, disable automatic renewal or submit a cancellation request through the Hostonce Client Area at https://bill.hostonce.com/ before the service's renewal deadline. Check the effective cancellation date and save any data you need before access ends. Domain expiry, renewal and recovery deadlines may differ from hosting deadlines.

Canceling a service and requesting a refund are separate actions. Submit an eligible refund request through the Client Area before closing the account. Eligibility, exclusions and service-specific windows are set out in the Cancellation & Refunds Policy at https://hostonce.com/cancellation-refunds. Mandatory consumer and payment-dispute rights remain unaffected.
